Terms & Conditions
These Terms and Conditions apply to accommodation, venue hire, private events, packages and other services provided by The Old Vic, 56 Gaskill Street, Canowindra NSW 2804, ABN 20 696 945 418.By making a booking, paying a deposit or entering the property, you agree to these Terms and Conditions.
1. Bookings
A booking is confirmed once we have issued written confirmation and received any required deposit or payment.
The person making the booking must:
-
be at least 18 years old;
-
provide accurate booking and contact information;
-
have authority to act for everyone included in the booking; and
-
ensure all guests and visitors comply with these terms.
The person making the booking is responsible for payment, damage and the conduct of all guests and visitors connected with the booking.
We may request photographic identification and valid payment-card details before check-in.
2. Rates and Payment
All prices are in Australian dollars and include GST where applicable.
Only the accommodation, meals, facilities and services identified in your booking confirmation are included in the price.
Unless otherwise stated:
-
accommodation bookings must be paid in full before arrival; and
-
additional charges incurred during a stay or event must be paid before departure or within the period stated on our invoice.
We may securely retain payment-card details for authorised charges associated with the booking, including unpaid accounts, additional cleaning, damage or missing property.
We will provide reasonable information supporting any damage or additional cleaning charge.
3. Accommodation Cancellations
The cancellation policy displayed when you book forms part of your booking. Unless another policy is expressly stated, the following applies to direct accommodation bookings:
More than seven days before arrival
You may cancel without charge and payments received will be refunded.
Three to seven days before arrival
A cancellation fee equal to 50% of the total booking value applies.
At our discretion, we may instead transfer the amount paid once to another available date within 12 months. Any difference in the accommodation rate must be paid.
Less than three days before arrival
The full booking amount is payable and non-refundable.
No-shows and early departures
No refund or credit is ordinarily provided where a guest:
-
does not arrive;
-
arrives after the booked date without notifying us;
-
leaves before the booked departure date; or
-
chooses not to use part of the accommodation or package.
Where possible, we will make reasonable efforts to re-sell cancelled accommodation. If we successfully re-sell it, we may refund the amount recovered after deducting reasonable administration costs and any reduction in the replacement booking price.
Nothing in this cancellation policy limits rights available under the Australian Consumer Law.
Bookings made through Airbnb, Booking.com or another third-party platform are also subject to the cancellation terms accepted through that platform.
4. Group Bookings and Property Buy-outs
A group booking includes:
-
five or more rooms;
-
a full or partial property buy-out;
-
accommodation associated with a private event; or
-
a booking subject to a group quotation or agreement.
The payment and cancellation terms contained in the group quotation or event agreement will apply.
Unless otherwise agreed:
-
a 25% deposit is required to confirm the booking;
-
a further 25% is payable 90 days before arrival;
-
the balance is payable 30 days before arrival; and
-
bookings made within 30 days of arrival must be paid in full when confirmed.
Reductions in rooms, nights or agreed minimum expenditure may be treated as partial cancellations.
Exclusive use applies only to the rooms and areas expressly identified in the booking confirmation. Other parts of The Old Vic may continue operating unless exclusive use of the entire property has been expressly purchased.
5. Check-in and Check-out
Unless otherwise agreed:
-
check-in is from 3:00 pm; and
-
check-out is by 10:00 am.
Early check-in and late check-out are subject to availability and may incur an additional charge.
Guests must follow the arrival and access instructions provided before check-in.
Where a late departure prevents us from preparing the room for an incoming guest, the departing guest may be responsible for the reasonable resulting costs.
6. Occupancy and Visitors
Only registered guests may stay overnight.
The number of occupants must not exceed the stated capacity of the room or booking. Children and infants must be included in the booking.
Guest rooms and common areas must not be used for an unauthorised party, function, commercial activity, photoshoot or gathering.
Visitors are permitted only with the approval of the registered guest and remain the responsibility of that guest. We may restrict visitors where necessary for safety, security, licensing or the comfort of other guests.
7. Guest Conduct
Guests must behave responsibly and respect other guests, staff, neighbours, the property and the Canowindra community.
The following are not permitted:
-
excessive noise;
-
unauthorised parties or events;
-
threatening, abusive or discriminatory conduct;
-
fighting, harassment or dangerous behaviour;
-
illegal activity or illegal drug use;
-
excessive intoxication;
-
deliberate or reckless damage; or
-
conduct that unreasonably interferes with another person’s safety, comfort or enjoyment.
Noise must be kept to a reasonable level at all times, particularly between 10:00 pm and 8:00 am.
We may refuse service, remove a visitor or require a guest to leave where reasonably necessary to protect people, property, amenity or our liquor-licence obligations.
A refund will not be provided where a stay or event is ended because of serious misconduct or a material breach of these terms.
8. Alcohol
Alcohol may only be supplied and consumed in accordance with applicable liquor laws and The Old Vic’s liquor licence.
Guests must not:
-
supply alcohol to minors;
-
bring alcohol into licensed event areas without approval;
-
behave in a violent, quarrelsome or disorderly manner; or
-
continue consuming alcohol after service has been refused.
Our staff may refuse service or require a person to leave where required or permitted by law.
No refund is payable because alcohol service has been lawfully refused.
9. Smoking and Vaping
Smoking and vaping are prohibited inside all rooms and internal areas of The Old Vic.
Smoking is permitted only in designated outdoor areas.
Where smoking or vaping occurs in a prohibited area, we may charge the reasonable cost of specialist cleaning, deodorising and any accommodation revenue lost while the room is unavailable.
Guests must dispose of cigarette butts safely and comply with all fire restrictions and total fire bans.
10. Children
Children are welcome but must be supervised by a responsible adult at all times.
The Old Vic is a historic building containing stairs, balconies, fireplaces, original features and changes in floor level. Parents and guardians are responsible for supervising children and determining whether the property is suitable for them.
Children must not enter staff-only areas, interfere with fireplaces or equipment, or climb on balconies, windows, furniture or historic features.
11. Accessibility and Historic Features
The Old Vic is a historic property. Some rooms and areas may include:
-
stairs;
-
narrow doorways or passages;
-
uneven surfaces;
-
original fittings;
-
changes in floor level;
-
limited step-free access; or
-
bathrooms located outside the guest room.
Guests with accessibility or mobility requirements should contact us before booking.
We will provide accurate information and make reasonable efforts to assist, but not every room or area will be suitable for every guest.
12. Pets and Assistance Animals
Pets are permitted only where the booking expressly identifies the accommodation as pet-friendly and the pet has been approved by us.
Approved pets must:
-
remain under effective control;
-
not enter restricted food-service areas;
-
not cause excessive noise or nuisance;
-
not use beds, linen or furniture; and
-
not be left unattended where they may cause distress or damage.

The guest is responsible for additional cleaning, damage or injury caused by their pet.
Assistance animals are welcome in accordance with applicable law. Guests are encouraged to notify us before arrival so suitable arrangements can be made.
13. Cleaning, Damage and Missing Property
Guests must leave rooms and shared areas in a reasonably clean and tidy condition.
The person making the booking is responsible for loss or damage caused by members of their group, visitors or approved pets, excluding reasonable wear and tear.
We may charge the reasonable cost of:
-
repairing damage;
-
replacing missing or damaged property;
-
specialist or excessive cleaning;
-
removing excessive rubbish;
-
treating stains, odours or contamination;
-
replacing lost keys or access devices;
-
responding to a false fire alarm caused by guest conduct; and
-
accommodation revenue reasonably lost while a damaged room is unavailable.
Guests should promptly report any existing damage or maintenance concern after arrival.
We will not charge guests for pre-existing damage, ordinary wear and tear or costs not reasonably connected with their booking.
14. Keys, Access and Security
Keys, access cards and entry codes remain our property.
Guests must not:
-
duplicate or share access credentials with unauthorised people;
-
provide entry to unregistered visitors;
-
interfere with locks or security equipment; or
-
enter staff-only, plant, storage, roof or restricted areas.
The reasonable cost of replacing lost access devices or restoring property security may be charged to the booking.
15. Parking and Vehicles
Parking is subject to availability unless expressly included or allocated in the booking.
Guests must:
-
park only in permitted areas;
-
avoid blocking driveways, emergency access or neighbouring properties;
-
follow signs and staff directions; and
-
not undertake vehicle repairs or hazardous activities onsite.

Vehicles and their contents remain the owner’s responsibility, except where loss is caused by our negligence or another matter for which liability cannot lawfully be excluded.
Electric vehicles may only be charged using an approved charging point. Guests must not run extension leads from guest rooms or general power outlets to a vehicle.
16. Personal Property
Guests are responsible for securing their belongings.
We are not responsible for loss, theft or damage to personal property except to the extent caused by our negligence, breach of contract or another matter for which liability cannot legally be excluded.
Found property may be retained for a reasonable period. The guest is responsible for postage, courier and handling costs associated with its return.
Perishable, hazardous or low-value items may be disposed of promptly.
17. Facilities and Services
Access to facilities and services may be affected by maintenance, private events, weather, fire restrictions, licensing requirements, staffing, safety concerns or circumstances outside our reasonable control.
The restaurant, kitchen and bar do not necessarily operate every day. Meals and beverage service are provided only where included in the booking or otherwise advertised as available.
Photographs and descriptions are provided in good faith. Rooms may vary in size, outlook, layout, furnishings and historic features.
We may make reasonable operational changes where necessary, provided the essential nature of the booking is not materially changed.
18. Fire Safety
Guests must comply with all fire-safety information, signs and staff directions.
Guests must not:
-
light fireplaces unless authorised;
-
use candles, incense, portable cooking appliances or naked flames;
-
cover or interfere with smoke detectors;
-
tamper with fire equipment;
-
block exits or fire doors; or
-
use outdoor fires, fire pits or barbecues without approval.
Tampering with fire-safety equipment may result in immediate removal from the property and liability for the reasonable resulting costs.
19. Private Events and Functions
No wedding, party, meeting, ticketed event, commercial activity, photoshoot or function may be held without our prior written approval.
Private events are subject to the accepted quotation or event agreement, including requirements concerning:
-
deposits and payment dates;
-
attendance limits;
-
operating hours;
-
minimum expenditure;
-
food and beverage service;
-
responsible service of alcohol;
-
noise restrictions;
-
staffing;
-
external suppliers; and
-
cleaning, security and damage.
Final guest numbers must be provided by the date stated in the event agreement. Unless otherwise agreed, the final invoice will be based on the confirmed number or actual attendance, whichever is higher.
No reduction is provided for guests who do not attend after final numbers have been confirmed.
20. Event Cancellations
The cancellation terms stated in the event quotation or agreement apply.
Unless otherwise stated:
-
the initial booking deposit is non-refundable;
-
cancellation between 90 and 180 days before the event attracts a fee equal to 25% of the agreed booking value;
-
cancellation between 30 and 90 days before the event attracts a fee equal to 50% of the agreed booking value; and
-
cancellation within 30 days of the event results in the full agreed booking value becoming payable.
We will take reasonable steps to rebook the date. Where replacement revenue is received for substantially the same facilities and services, we may reduce the cancellation charge to reflect losses avoided.
These charges are intended to reflect costs, administration, preparation and the lost opportunity to accept another booking. They are not intended to operate as a penalty.
21. External Suppliers
External suppliers must receive prior approval where they will provide food, beverages, entertainment, equipment, decorations, photography or other services at the property.
We may require suppliers to provide evidence of:
-
public liability insurance;
-
relevant licences or qualifications;
-
safe-work documentation;
-
electrical testing and tagging; and
-
compliance with food, liquor and workplace requirements.
Nothing may be attached to walls, ceilings, floors, trees, fixtures or historic features without approval.
Confetti, glitter, rice, smoke devices, fireworks, open flames and similar items are prohibited unless expressly approved in writing.
22. Food and Dietary Requirements
Dietary requirements and allergies must be provided by the date stated in the booking confirmation or event agreement.
We will take reasonable care in responding to disclosed dietary requirements. However, food is prepared in facilities where allergens may be present, and we cannot guarantee a completely allergen-free environment.
Guests with serious allergies should notify us in writing and speak directly with the relevant manager before consuming food.
Menus may change due to seasonality, availability or supplier issues. Where an item is unavailable, we may substitute an item of reasonably comparable quality.
23. Photography and Commercial Use
Guests may take photographs for personal use, provided this does not interfere with staff, other guests or private events.
Commercial photography, filming, drone use, media activity and promotional shoots require prior written approval and may attract a location fee.
We will not use identifiable photographs of guests for advertising without appropriate permission.
24. Privacy
We collect personal information reasonably required to:
-
manage bookings and payments;
-
communicate with guests;
-
provide services;
-
maintain safety and security;
-
comply with legal obligations; and
-
send marketing communications where permitted.
Information may be shared with booking platforms, payment processors, service providers, insurers, professional advisers and authorities where reasonably necessary.
Guests may unsubscribe from marketing communications at any time.
Guests should not send payment-card details through ordinary email.
25. Circumstances Beyond Our Control
Neither party will be responsible for failing to perform an obligation where performance is prevented by circumstances beyond that party’s reasonable control, including natural disaster, flood, bushfire, severe weather, government restriction, road closure, utility failure, industrial action or emergency.
Where we cannot provide the booked accommodation or event, we may offer an alternative date, substitute service, credit or refund, depending on the circumstances and applicable law.
Nothing in this section removes rights that cannot be excluded under the Australian Consumer Law.
Guests are encouraged to obtain suitable travel or event insurance.
26. Cancellation by The Old Vic
We may cancel or terminate a booking where:
-
payment is not made when due;
-
materially false information has been provided;
-
the booking appears unlawful or unsafe;
-
guest numbers or the nature of the booking have been misrepresented;
-
a guest materially breaches these terms;
-
continuing the booking would breach a law, licence or official direction; or
-
the property cannot reasonably or safely provide the booking.
Where we cancel for operational reasons and the guest is not at fault, we will refund amounts paid for services that are not provided and comply with our obligations under the Australian Consumer Law.
Where a booking is terminated because of serious misconduct, non-payment or a material breach by a guest, the guest remains responsible for our reasonable resulting losses.
27. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these terms excludes, restricts or modifies any statutory guarantee, right or remedy that cannot legally be excluded.
To the extent permitted by law, we are not responsible for indirect or consequential loss that was not reasonably foreseeable when the booking was made.
28. Complaints
Guests should promptly notify us of any issue affecting their stay or event so that we have a reasonable opportunity to inspect and address it.

29. Governing Law
These Terms and Conditions are governed by the laws of New South Wales, Australia.
If any provision is invalid or unenforceable, it will be read down or removed to the minimum extent necessary. The remaining provisions will continue to apply.
30. Acceptance
By making a booking, paying a deposit or entering the property, you acknowledge that you have read and accepted these Terms and Conditions.
The person making the booking must bring these terms to the attention of all guests, visitors and suppliers included in the booking.
SMS and Text Messaging Policy
We use a guest messaging platform to communicate with you regarding your stay. By providing your phone number during the booking process, you consent to receive text messages from the property.
Purpose: Text messaging may be used to send check-in instructions, access information, room readiness updates, and to respond to your requests during your stay.
Opt-Out: You may opt out of receiving text messages at any time by replying STOP to any message you receive. You will receive a final confirmation message, after which no further SMS messages will be sent.
Help: If you experience issues or need assistance, you may reply HELP or contact the front desk directly.
Privacy of Mobile Data: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent will not be shared with any third parties.
